3rd Circuit Says Worker's Comp Settlement Didn't Bar Lawsuit Against Employer

The U.S. 3rd Circuit Court of Appeals revived a worker’s suit against his former employer, finding his settlement of a comp claim had not waived his ability to bring an action for violations of the Family and Medical Leave Act, or Pennsylvania common law. Case: Zuber v. Boscov’s, No. 16-3217, 09/11/2017, published. Facts: Craig Zuber worked for Boscov's Inc. After he suffered an on-the-job injury on Aug. 12, 2014, he filed a workers' compensation claim, and he missed two days of work.
