Supreme Court Asked to Rule on TTD Cap for Non-Surgical Soft-Tissue Injuries

The Oklahoma Supreme Court is being asked to weigh in on whether a worker who has received the statutory maximum amount of temporary total disability benefits for a soft-tissue injury that doesn't require surgery can receive additional TTD compensation if a doctor later determines that surgery is warranted. Last month, the Workers' Compensation Commission unanimously found that once Darla Jean Camp underwent surgery, the limitations of Oklahoma Statute 85A-62 were inapplicable to her. Section 62 limits a worker to no more than 32 weeks of TTD for a nonsurgical soft tissue injury. But...
