Ohio Industrial Commission hearing officers are free to reject the opinions of job-retraining specialists, but one officer went too far when he dismissed a specialist’s entire report without considering its merits because he thought she had a conflict of interest, the Ohio Supreme Court decided Thursday.
The high court didn’t agree that Khanisha McCoy had a conflict of interest and said the hearing officer had abused his discretion by dismissing her report on this basis.
