A Northern California city is appealing a January decision by a divided Workers' Compensation Appeals Board panel that the city was not entitled to benefit from the Labor Code's so-called "bump-up, bump-down" incentive for employers to return injured employees to work where the applicant missed no time on the job. Commissioner Alfonso Moresi dissented, reversing course from his prior stance that the Labor Code recognized a distinction between applicants who lost time from work and those who had not.
