The Montana Department of Labor & Industry will hold a virtual hearing to discuss proposed rules to implement Senate Bill 367, the agency announced.
SB 367 prohibits employee status from being determined solely due to the lack of an Independent Contractor Exemption Certificate in certain situations, L&I said.
The new rules will clarify instances where a worker’s status is determined by the state’s AB test instead of a conclusive presumption of the ICEC status.
The hearing is scheduled to begin at 9 a.m. Mountain time on Oct. 8.
