A Texas appellate court revived part of an injured worker’s negligence suit against his nonsubscribing employer for injuries from climbing out of the bed of his work truck. Samuel Adams Flores worked for Oil-Tech Construction LLC. Every morning for over two years, before driving a company vehicle out to his work site for the day, Flores would inspect the vehicle.
