An Ohio appellate court last week ruled that a worker who tested positive for marijuana metabolites after a workplace accident was still entitled to workers' compensation benefits.
In the absence of evidence that Michael G. Trent was under the influence of marijuana when he got hurt, or that his use of cannabis several weeks prior to his accident had anything to do with the cause, a panel from the state's 5th District Court said that he remained entitled to benefits for his injuries.
