California's 2nd District Court of Appeal will hear oral argument in a constitutional challenge to the lien fee provisions of SB 863 in two months.
The parties in Chorn v. Brown, No. B264440, are set to present their respective positions to the court at 9 a.m. on March 17.
SB 863 had required that lien claimants pay a $150 "activation" fee for every claim that was pending as of Jan. 1, 2013; otherwise, the claims would be automatically dismissed at the start of 2014. It also imposed a $100 filing fee on any new claims.
