The Nevada Workers’ Compensation Section said insurer action is required with respect to cost-of-living adjustments for all permanent total disability and death benefits claims.
Senate Bill 377 and Assembly Bill 370, both enacted in 2019, require carriers to pay an annual 2.3% cost-of-living adjustment on all PTD and survivors’ benefits claims. The expenses related to COLA payments should be included as part of reported claims expenditures and are included in the calculation of the Workers’ Compensation and Safety Fund Assessment for each insurer.
