The final round of briefs filed ahead of next week’s hearing on a constitutional challenge to the automatic stay on liens filed by providers charged with fraud focuses heavily on whether California lawmakers cured the alleged due process violations this year.
Plaintiffs, who include a doctor accused of accepting kickbacks in a compound drug scheme, and a medical billing firm, said there is nothing in Assembly Bill 1422 that gives lien claimants a guaranteed right to challenge whether a lien should have been stayed.
