Court Revives Labor Law Claim by Worker Struck by Out-of-Control Dolly

A New York appellate court revived a construction worker’s Labor Law claim for his alleged injuries from being struck by a dolly after he lost control of it while pushing it up a ramp. Case: Kandatyan v. 400 Fifth Realty, No. 2015-10578, 11/15/2017, published. Facts: Aram Kandatyan worked for Nastasi & Associates as a carpenter apprentice. In May 2010, he allegedly suffered injuries while attempting to push a dolly loaded with drywall material up a temporary plywood ramp.
