Recent state actions have provided employers a shield from the cost of virus-related comp claims and liability suits. But that has raised new questions about whether the protections could discourage companies from pursuing more robust worker safety measures.
Rating bureaus for most U.S. states have now said insurers should refrain from counting COVID-19 claims on employers' experience ratings. The New York Compensation Insurance Rating Board was one of the first, with a notice in early May that claims from virus-sickened workers should be excluded from experience calculations.
