One of the guiding principles behind Senate Bill 863 was the idea that doctors, not judges, should be making medical decisions. But employers say the Division of Workers' Compensation's plan to start penalizing claims administrators who don't send all relevant records to independent medical review could undermine that objective by forcing judges to decide what records are relevant to a worker's medical condition.
