The Florida 1st District Court of Appeal on Tuesday granted an injured worker’s motion to remove Judge of Compensation Claims Jack Weiss from his case because of the worker’s concern that the judge was biased against his attorney. The appellate court's order in Lowman v. Racetrac Petroleum marks the second time in less than a month where a judge's ruling was overturned because of comments about an attorney’s perceived lack of candor.
