A bill introduced in New Jersey would adopt a three-part test to determine whether workers are employees or independent contractors.
New Jersey Senate President Stephen Sweeney, D-West Deptford, introduced S4204 on Nov. 7, proposing to create a rebuttable presumption that workers are employees and not independent contractors.
The test to rebut the presumption would require proving the worker:
Is free from control and direction over the performance of the service.
Is performing a service that’s outside the usual course of the business for the hiring entity.
