The Oklahoma Supreme Court will be weighing in on two cases challenging the state’s statutory cap on the benefits payable for hernia injuries.
Section 61 of the Administrative Workers’ Compensation Act provides that a claimant with a compensable hernia injury can receive only six weeks of temporary total disability benefits. Attorneys Bob Burke, Katie Samples and Charles Simons are challenging these limitations in a case called Corbeil v. Emricks Van & Storage.
