Facts and procedural history: Raymond Snyder worked for Western Construction Specialties. While he was at work in July 1999, a hammer fell about 70 feet down an elevator shaft and struck him on the right shoulder.
After the accident, Western sent Snyder for a medical evaluation and X-rays. The X-rays did not reveal any broken bones.
