A psychiatrist convicted on a single charge related to the overdose death of Anna Nicole Smith is asking a federal judge to declare that California's process of suspending providers from the workers’ compensation system is unconstitutional.
Dr. Khristine Eroshevich says in her complaint that the basis for the proposed suspension is “wrong and inaccurate, and is capricious and arbitrary.” She said there is no conviction upon which the Division of Workers’ Compensation can seek to suspend her ability to treat injured workers.
