The Nebraska Court of Appeals upheld a determination that a worker was permanently and totally disabled by a back injury, but that her employer was not liable for the cost of a spinal cord stimulator she had implanted in an attempt to control her back pain.
Case: Yost v. Davita, Nos. A-15-197, A-15-234, A-15-235, 12/29/2015, published.
Facts: Debra Yost injured her back in 2008 while working for Davita Inc. The Workers' Compensation Court found her to be at maximum medical improvement by November 2009, and found her injury caused a 35% permanent loss of earning capacity.
