Judge Denies BP's Request for Summary Judgment on Comp Remedy in Chemical Release

A U.S. district court judge in Texas denied a motion by BP Products North America for partial summary judgment in a case stemming from an alleged chemical release over a number of days at a Texas City BP refinery in November 2011. Judge Keith Ellison said in his decision that BP had failed to prove that workers’ compensation was the exclusive remedy for 315 “worker” plaintiffs who claim they were affected by the chemical release.
