The Court of Appeals this week ruled that the exclusive remedy provision of the Georgia Workers' Compensation Act did not bar a mother's tort suit over the murder of her son almost exactly four years ago.
The mother of slain warehouse worker Nickifor Zephyrine contends that a proper background check would have revealed that the man who murdered her son had a history of felony crimes and was using a fake identity. Christopher Lema is now serving a life sentence for the crime.
