1st DCA Wrapping Up Briefing Process for Constitutional Challenge to IMR

The California 1st District Court of Appeal has agreed to hear a case that brings a constitutional challenge to the independent medical-review process mandated by Senate Bill 863. A date and time for the oral argument in Stevens v. WCAB, No. A143043, has not yet been set. Briefing in the matter is set to wrap up next Monday. The case is actually the second attempt by San Francisco applicants' attorney Joseph Waxman to get an appellate court to weigh in on whether IMR comports with due process.
