§ 59A-29.006 Decertification Process.

(1) The Agency shall review a health care provider's certification to determine whether suspension or decertification is required when requested to do so in writing.

(2) All requests to the Agency to review a health care provider's certification shall be submitted in writing to the Agency. Documentation necessary to substantiate the perceived need for Agency review shall accompany the request. Anonymous requests shall not be reviewed. Reports and documentation, except for violations addressed by Section 440.13(8), F.S., shall be sent to the following address: Agency for Health Care Administration, 2727 Mahan Drive, Mail Stop-26, Tallahassee, Florida 32308-5403.

(3) When, upon review of all submitted documentation, the Agency finds that a health care provider has engaged in or committed any of the actions set out in subsection 59A-29.005(1), F.A.C., the Agency shall suspend certification of that health care provider for a length of time to be determined as follows: (a) When suspension of certification is based upon paragraph 59A-29.005(1)(a), F.A.C., the duration of suspension shall be: 1. 12 months for one of the violations established in Section 440.13(13)(a) through (f), F.S.; 2. 24 months for multiple violations of Section 440.13(a) through (f), F.S.; (b) When suspension of certification is based upon paragraph 59A-29.005(1)(b), F.A.C., the duration of suspension shall be equal to and run concurrently with the duration of revocation, suspension, or probation imposed by the Agency for Health Care Administration, or agreed to by the health care provider.

(4) When a health care provider is suspended a second time, the Agency shall revoke certification for a period of time, twice as long in duration as the first period of suspension.

(5) When a health care provider is suspended a third time, the health care provider shall be decertified and shall not be eligible to become recertified.

(6) Suspension and decertification of health care providers for violations of Sections 440.13(8) and 440.13(13)(g), F.S., shall be for the duration of time set forth in administrative rules adopted by the Agency pursuant to Sections 440.13(8) and 440.13(13)(g), F.S.
