§ 59A-29.011 Workers' Compensation Certification Training Courses.
| (1) All certification training courses offered to health care providers to meet the requirements of Section 440.13(3)(a), F.S., shall be submitted for, and receive, Agency approval prior to the presentation of the course.
(2) To receive Agency approval, a training course must be a minimum of five (5) hours and must address the following: (a) Cost containment; and (b) Ergonomics; and (c) Practice parameters governing the physician's field of practice; and (d) Utilization control; and (e) Return to work. (3) The Agency's certification training course outline contains those components required to be included in each certification training course. (4) Within 120 days of receipt of a training course proposal the Agency shall notify the vendor in writing that the course is approved, specify the additional requirements needed for course approval, or deny approval. No training proposals submitted to the Agency for approval shall be returned. (5) A certification training course approved by the Agency shall maintain its course approval status for three (3) years unless the approval is revoked. When a vendor intends to offer the course after the expiration date, the course must be resubmitted. (6) Section 440.13, F.S., as well as any revisions or amendments to Section 440.13, F.S., and Agency adopted administrative rules shall be included in all certification courses. Notification of course adjustments shall be made through a Agency bulletin. (7) In order for a certification training course to be approved, the following shall be submitted to the Agency as part of the proposed training course: (a) Name and credentials of instructor(s) or author(s) and copy of license, if applicable, and documentation substantiating the qualifications of the instructor(s). Credentials of at least one substitute instructor(s) per area of instruction must also be included. Instructors must have: 1. Professional license in a health care or related field and 10 years experience in the area in which licensed to practice; or 5 years experience in workers' compensation or safety; or 3 years experience in the specific area of cost containment, ergonomics, practice parameters, or utilization control; or 2. Professional license in a health care or related field and be a current employee of the Agency for Health Care Administration, the Division of Safety, or the Agency. (b) Syllabus and outline of course content including time frames for each component and schedules for any breaks or meals included in the presentation. If audio-visual materials are to be utilized, a qualified and approved instructor must be present, during the audio-visual presentation, to answer questions on the subject matter presented. (c) Copy of course completion certificate which shall include name of vendor, instructor(s), date and location of course. (d) Copies of all texts, brochures, audio-visuals and all other course materials and handouts that will be utilized during the course presentation. (e) The certification training course outline developed by the Agency and the Certification Taskforce is hereby incorporated into this rule chapter by reference and shall be distributed to the participants of certification training courses approved by the Agency. A copy of the certification training course outline is available from the Agency for Health Care Administration, 2727 Mahan Drive, Mail Stop-26, Tallahassee, Florida 32308-5403. The version of certification training course outline required by this rule to be distributed shall bear the date October 15, 1994. (8) No later than one (1) month prior to offering an approved course, a vendor shall notify the Agency in writing of the date(s) and location(s) (city, name of facility) of each course offering. Point of contact and telephone number shall be included. Printed information to be used for promotional or publicity purposes is sufficient to meet the requirements of this paragraph, provided all required information is set forth. (9) The vendor or certification training course instructor shall send to the Agency within ten (10) business days following course completion a roster of attenders including the name, license number, address, telephone number and specialty of each participant. Each participant must sign his/her name next to their typed or computer printed name. The roster must identify the vendor, as well as the date, time, place of the course, and name(s) of instructor(s). (10) The Agency shall monitor and audit approved courses on dates that such courses are presented in order to ensure the quality and content of such courses. (11) For the purposes of meeting the requirements of Section 440.13(3)(a), F.S., health care providers shall not receive credit for attending a course prior to the date that the Agency approves such course. (12) The Agency shall revoke its approval of a certification training course for any one of the following grounds: (a) Substitution of course instructor(s) without prior Agency approval. (b) Elimination of course components which were approved by the Agency as part of the training course. (c) Falsification of any course completion record or other document related to the course. (d) Failure to send a completed roster to the Agency as required by subsection (9) of this rule. (13) A certification training course that has had its approval revoked shall not be reconsidered for Agency approval for a period of no less than six (6) months from the date of notification of revocation. After the six (6) month waiting period, the course may be resubmitted following the requirements set forth in this rule. Proof of corrected deficiencies shall be submitted. (14) The Agency shall not reapprove a course if Agency revocation is based upon a violation of paragraph (12)(c) of this rule. Specific Authority 440.13(3)(a), 440.591 FS.
