§ 2053.010 Administrative Penalty
| (a) The commissioner may assess an administrative penalty against an insurance company if the commissioner determines, based on a pattern of charges for premiums, that the company is consistently overcharging or undercharging the company's policyholders for workers' compensation insurance.
(b) An administrative penalty under this section must be: (1) assessed in accordance with Section 415.021, Labor Code; and (2) set by the commissioner in an amount reasonable and necessary to deter overcharging or undercharging of policyholders.
