§ 4.19 Tax Administration Functions; Reimbursement of General Revenue Fund
| (a) The department shall reimburse the general revenue fund for the
amount of expenses incurred by the comptroller in administering the taxes imposed under this code or another insurance law of this state in accordance with this article. (b) The comptroller shall certify to the commissioner the total amount of expenses estimated to be required to perform the comptroller's duties under this code or another insurance law of this state for each fiscal biennium. The comptroller shall provide copies of the certification to the budget division of the governor's office and to the Legislative Budget Board. (c) The amount certified by the comptroller under Subsection (b) of this article shall be transferred from the Texas Department of Insurance operating fund to the general revenue fund. It is the intent of the legislature that the money in the department's operating fund that is to be transferred into the general revenue fund under this subsection should reflect the revenues from the various maintenance taxes paid by insurers under this code or other insurance laws of this state. (d) In setting the maintenance taxes for each fiscal year, the commissioner shall ensure that the amount of the taxes imposed is sufficient to fully reimburse the general revenue fund for the expenses incurred by the comptroller in administering the taxes imposed under this code and other insurance laws of this state. If the amount of maintenance taxes collected is insufficient to reimburse the general revenue fund for the expenses incurred by the comptroller in administering the taxes imposed under this code and other insurance laws of this state, other money in the department's operating fund shall be used to reimburse the general revenue fund in accordance with Subsection (b) of this article.
