§ 132.1 Calculation of Death Benefits.

Death benefits shall be computed by multiplying the employee's average weekly wage by .75. The amount paid shall not exceed 100% of the state average weekly wage as determined by the Texas Workers' Compensation Commission and in effect on the date of injury. A claim for death benefits shall be filed as required by section 122.100 of this title (relating to Claim for Death Benefits).
