Insurance Commissioner Must Sue in Carrier's Home County

The Montana Supreme Court this week ruled that a dispute between the state’s insurance regulator and a workers’ compensation insurance carrier needs to be heard in the county where the carried maintained its principal office. The Montana Commissioner of Securities and Insurance filed a complaint in the Lewis and Clark County District Court in September 2017, seeking penalties and an injunction barring the Victory Insurance Co. from continuing to engage in conduct that allegedly violated the Holding Company Act.
