A former state employee who lost his job after getting hurt at work has also lost his challenge to his termination.
On Tuesday, a unanimous panel from the Western District of the state Court of Appeals ruled that the Administrative Hearing Commission – the agency with jurisdiction over disciplinary actions against state employees – couldn't order the Missouri Department of Corrections to reinstate James D. Fitzsimmons and accommodate his limitations while he recovered from his ankle injury.
