California now has new binding precedent on the authority of the Workers’ Compensation Appeals Board to impose penalties against a public employer.
Last month, the 3rd District Court of Appeal changed its decision regarding Gage v. WCAB (County of Sacramento) as an unpublished opinion, meaning it could not be cited as authority in any other case.
