The Idaho Supreme Court last week ruled that a worker suffering from physical limitations and severe depression was not permanently and totally disabled.
The case was Smith v. State, No. 45674.
Kevin Smith fell from a balcony in July 1997, injuring his feet. Dr. Edward Tapper performed surgery and put casts on both feet.
Smith could not walk for more than a year, nor could he work in general construction. He was evicted from his apartment and lived in a car with his wife and their infant child.
