The Tennessee Court of Appeals last week ruled that a workers’ compensation insurance carrier can proceed with its claim for indemnification from a construction company allegedly serving as a borrowed employer for its insured’s employee when the employee was killed in a crane accident.
The accident occurred in May 2009, while Comanche Construction was making repairs to a bridge in Dyersburg, Tennessee.
