A group of Oklahoma claimants’ attorneys are asking the state Supreme Court to reconsider its decision upholding the constitutionality of a statutory requirement for the use of the sixth edition of the American Medical Association Guides to the Evaluation of Permanent Impairment to determine disability ratings.
Last month, a divided Supreme Court ruled that the mandated use of the guides was not an improper delegation of legislative authority and not an unconstitutional restraint on the judiciary.
