The Texas Division of Workers’ Compensation Wednesday proposed informal draft rules that would fine-tune its process for imposing penalties, as directed by legislation passed last year.
The division said Senate Bill 1895 requires it to consider two additional factors when assessing an administrative penalty: Whether the violation had a negative impact on the delivery of benefits to an injured worker, and the history of compliance with electronic data interchange requirements.
