The New York State Workers’ Compensation Board on Monday explained how it will measure and monitor payer performance as part of a program that one defense attorney says is illegal and will invite a court challenge.
Starting Saturday, payers must meet a performance goal for timely filing of notices of controversy, which are used when claims are controverted. The first quarter's goal will be 70%, meaning insurers must meet timelines in seven of every 10 cases.
The goal increases 5% each quarter until it hits 85% for the second quarter of 2018.
