Agency Wants to Repeal 'Outdated' Rules on Requests for Information

The Texas Department of Insurance’s Division of Workers’ Compensation is accepting public comments on a proposal to repeal 28 TAC Chapter 57, Request for Case Folders and Certification of Actions of the Board. The rules are outdated and longer needed, since other statutes and rules govern access to records and requests for public information, says Emily McCoy, DWC associate general counsel. In a Nov. 30 memo to stakeholders, McCoy said the repeal is tied to Texas Government Code §2001.039, which requires DWC to review and consider readopting, amending or repealing its rules ...
