Oregon’s Workers’ Compensation Division adopted temporary changes to its vocational assistance rules in light of an appellate court decision finding that the current regulations are not consistent with statute.
The Court of Appeals in a Feb. 14 decision said the division's rules failed to account for an injured worker’s supplemental earnings when determining eligibility for vocational assistance. Workers are entitled to vocational assistance if their post-injury earnings are less than 80% of their pre-injury wages.
