California's 6th District Court of Appeal is being asked to make its decision declining to impose the "Daubert standard" for expert testimony into binding precedent. The court's Jan. 21 decision in Star Insurance Co. v. WCAB (Tavares) was initially released as an unpublished ruling – which means it only carries persuasive value.
