The Montana Department of Labor and Industry will hold a pubic hearing March 1 on proposed rules regarding certification of independent contractors.
The proposed rules would declare that a person holding an Independent Contractor Exemption Certificate is conclusively an independent contractor. If a worker is required to hold such certification but does not, that person would conclusively be considered an employee, under the proposal.
The department also proposed revisions to simplify requirements for certifying contractors.
