An Ohio appellate court upheld the denial of a former nurse's petition for permanent total disability benefits for back pain and anxiety.
The court found that the Industrial Commission did a thorough enough job when rejecting her PTD application based largely on a psychologist's finding that "the worker's limitations at this point are primarily the result of pre-existing personality weaknesses."
It did not matter, the court held, that the psychologist had examined the nurse to answer a question about temporary total disability benefits, not PTD benefits. ...
