The California Supreme Court will not disturb a decision from the 4th District Court of Appeal that said there is an absolute five-year statutory cap on the duration of temporary disability benefits.
Labor Code Section 4656 states that temporary disability benefits “shall not extend for more than 104 compensable weeks within a period of five years from the date of injury” for all injuries occurring on or after Jan. 1, 2008.
