An employer that wrote an "ambiguous" notice denying a widow's workers' compensation claim may have given the woman a shot at proceeding with a wrongful death suit instead.
The Florida 4th District Court of Appeal ruled that a trial court erred in dismissing the wrongful death suit because the employer's letter denying the work comp claim left a question as to whether the employer had taken an inconsistent position when claiming immunity from the tort suit.
