Division Updates Death Benefits Claim Form

The Texas Division of Workers’ Compensation has issued a new version of DWC Form-042, the notice of fatal injury or occupational disease and claim for death benefits.The form notes that eligible beneficiaries have one year after the date of the employee’s death to file the form with the division, unless the person is “a minor or incompetent,” a beneficiary other than an eligible nondependent parent, has good cause for the failure to file a claim or “an eligible nondependent parent submits proof satisfactory to the commissioner of a compelling reason for the delay....
