The Oregon Workers’ Compensation Division has issued a bulletin on the determination of “gainful occupation” for permanent total disability evaluations.
The bulletin updates the annual percentage of change in the federal poverty guidelines for a family of three that apply to Oregon residents. It also provides examples of using gainful occupation to determine eligibility for PTD benefits. The bulletin replaces one dated Feb. 13, 2017.
