Court Partially Revives Labor Law Claim Based on Alleged Skid Loader Defect

A New York appellate court partially revived a worker’s Labor Law claims based on his alleged injuries from a defective safety bar on a skid loader. Case: Salerno v. Diocese of Buffalo, No. 330 CA 17-01548, 05/04/2018, published. Facts: James Salerno allegedly suffered injuries while working on a construction project at a cemetery in the Town of Tonawanda. The cemetery was owned by the Diocese of Buffalo, New York. As part of his work at the cemetery, Salerno used a Bobcat skid loader.
