Facts: Thomas Kehoe Jr. worked for P.S. Marcato Elevator Co. Inc. He allegedly suffered injuries in a fall from a ladder in an elevator shaft. The ladder was permanently affixed to the shaft and was the only means by which he could access the elevator pit.
He claimed the ladder vibrated and caused him to fall about 20 feet to the floor.
