WCAB Overturns Estoppel-Based Extension of TTD

The Workers’ Compensation Appeals Board (WCAB) has overturned an administrative law judge who estopped an employer from asserting the 104-week cap on temporary total disability benefits based on delays in authorizing two needed surgeries. The Jan. 2 panel decision was not labeled "significant," and therefore can't be cited, but Paul Karasoff, the defense attorney in the case, said he believes "it’s an indication that the board is going to adhere closely to the statutory language regarding the 104-week limitation."
