The California Supreme Court this morning published a decision in King v. CompPartners finding workers’ compensation law provides the exclusive remedy for injuries allegedly flowing from adverse utilization review decisions.
A utilization review doctor in 2013 concluded Klonopin was not medically appropriate for Kirk King, who had been taking the anti-psychotic drug since 2011. King immediately stopped taking the drug, suffering four seizures as a result.
King and his wife sued the UR doctor for negligence alleging she had a duty to warn him about the dangers of withdrawal.
