A Texas appellate court partially revived an injured worker's negligence claims against a cement plant owner who had hired his employer to build a truck port.

Facts: Amistad Ready Mix hired Jesse Carrillo to build a truck port at its cement plant. Carrillo then hired Rolando Hernandez to assist him with the project.
