A New York appellate court ruled that a worker was not entitled to summary judgment on his Labor Law claim for a fall from a scaffold while demolishing a cinder block wall.

Facts: Eduardo Gelvez suffered injuries while demolishing a cinder block wall. Part of the wall he was demolishing collapsed onto the scaffold on which he was working, knocking the scaffold over and causing him to fall.
